FMI Better Bread Company Inc. (“Better Bread”) is a proud franchisee of the Panera Bread® restaurant brand in Canada. We at Better Bread know that your privacy is important. This Privacy Policy sets out our privacy practices that apply when you visit any Panera Bread® restaurants that we own and operate or use any Panera Bread® branded Canadian website, mobile or tablet application (“App”), digital in-restaurant kiosk, or other Panera Bread® online service or platform that we own or operate, as well as our other interactions with you, including on third-party platforms (such as social media). 

This Privacy Policy does not apply to privacy practices relating to other Panera Bread® franchisees or the operations of the Panera Bread Company, or its parent companies or subsidiaries. For example, such other entities may run promotional oers specific to their locations and digital sites and may collect personal information for the purposes of administering such oers and sites, and are responsible for their own privacy practices which you should review separately. The Panera Bread® system is made up of company-operated, franchised, and licensed Panera Bread® restaurant and commercial products businesses. This means that we, as a Panera Bread® franchisee, independently own and operate our business and may do certain things dierently than other entities in the system. Such other entities are not responsible or liable for any of our services, even if linked to our services, or for our privacy practices. 

Collection and Use of Personal Information 

We may collect and use personal information when you: 

  • Buy or use our products, including when you visit a restaurant or place an order for pick-up or delivery, such information may include: 

o If you pay with another payment method (e.g., credit card, debit card), we may collect your payment method details (e.g., card number, expiry date, etc.) for the purposes of processing your payment. 

  • Create and participate in the MyPanera® Canada loyalty program;
  • Sign-up to receive marketing emails such as newsletters, oers and promotions; 
  • Enter a contest or participate in an event or promotion; 
  • Donate to one of our fundraising or community initiatives; 
  • Apply for a job at Better Bread; 
  • Contact us with a comment, question or complaint;

When you purchase a product from us, we may collect and use personal information, including: 

Personal Information Collected In-Restaurant 

Closed-Circuit Television (CCTV) 

  • In some locations operated by Better Bread, we use closed-circuit television (CCTV) cameras in our stores for security, fraud prevention, and incident reporting and loss-prevention purposes. 

In-Store Wi-Fi. 

  • Better Bread-owned restaurants may provide you with access to free public Wi-Fi. If you choose to connect to our in restaurant Wi-Fi system, we may receive personal information about you and your device, including your device ID, IP address, received signal strength indicator (RSSI) and technical details about your device such as its operating system and version, device type (including make and model) and technical capabilities for the purposes of delivering the Wi-Fi service. 

Personal Information Collected While Using Online Services. 

  • If you interact with us through our online services, you will be asked to create an account by entering your first name and last name, email address, phone number and postal code. When you place an order using our online services, we will collect further information from you, including your order details, location (the extent of which is based on the geolocation settings on your mobile device and with your express consent), address, phone number and payment information to complete your order. We may oer you the ability to order through a third-party food delivery platform, in which case we will obtain your information from the third-party in order to fulfil your order. This information is used to process, fulfill and deliver your request, and may be used for the purposes of tailoring oers to you on our platforms and third-party platforms. 
  • We may use automated technology to collect information from your computer system or mobile device when you visit our restaurants, use our online services, or in-restaurant technology (e.g., internal protocol (“IP”) address, cookies, etc.). 

MyPanera® Canada Loyalty Program. 

  • You can earn and redeem points with our MyPanera® Canada loyalty program. If you choose to join, you must create an online account and provide your name, email address, phone number, postal code, username and a password

you create. This information will be used to create your MyPanera® Canada loyalty account, to manage our relationship with you, and to personalize and improve your overall customer experience and to administer your participation in our MyPanera® Canada loyalty program. We also may collect information about the products you buy, including where and how frequently you buy them, your use of coupons and stored-value cards, your participation in our MyPanera® Canada loyalty program, your purchases and purchase habits and history, your progress towards rewards, and the rewards you earn and redeem through our MyPanera® Canada loyal program, so that we can better serve you. Information Collected About your Device and Usage of our Services 

  • In addition to the information you provide to us directly, we (and our third-party service providers on our behalf) may collect information about your use of our services, including the App and our website. We use this information to help us understand the activity on the App and our website, to monitor and improve our products and services, including the App and our website, to manage and analyze data in order to better understand our users, and to tailor your experience when using our services. For example, we may collect: 

o Device information - such as your hardware model, IP address, other unique device identifiers, operating system version, and settings of the device you use to access our services. 

o Usage information - such as information about the services you use, the time and duration of your use of our App or website, what portions of our App or website you use, how often you use them, what links or materials (including advertising) you click when using our App or website, whether you open the emails we send, what materials (including advertising) you view when using our App or website, whether you make a purchase after seeing or clicking advertising we serve, the search terms you use, and other information about your interaction with content oered through our App and website, and any information stored in cookies and similar technologies that we have set on your device. 

o App Usage Information - as with many online services, certain limited data is required for our App to function on/with your device. This data includes the type of device hardware and operating system, unique device identifier, IP address, language settings, and the date and time the App access our servers.

o Location information - such as your computer’s IP address or general location (e.g. city/town/province/country), or with your express consent and based on your mobile device’s geolocation settings, your mobile device’s GPS-based location. Your location information is used to help you find local restaurants, provide you with relevant oers and deals available near you, and provide you with other relevant information that relates to your location. You can adjust your location preferences at any time in your device settings. 

o Analytical Information - We may use third-party service providers to collect analytical information about your use of the App, such as the feature you use and/or time spent on the App, collectively for the purposes of helping us to improve the App experience for all users and to manage and analyze data in order to better understand our users. 

o Fraud Prevention - We may also monitor use of our App, website and services by our guests in order to detect, investigate or prevent any actual or potential violation of our terms and conditions. We may generate aggregated, non-identifiable data and use such information to monitor and improve the performance, use and stability of the App, website and our services. 

Marketing Email Marketing Communications. 

  • If you sign-up to receive email marketing communications from us about products, services, events, programs, promotions, and special oers that may interest you, you can unsubscribe at any time by clicking the “unsubscribe” link included at the bottom of each email or changing your settings in the Preferences section of your account. Please note that you may continue to receive transactional or account-related communications from us. 
  • With your consent, we may also send push notifications on your mobile device about MyPanera® Canada promotional oers and other events, contests and promotions. If you wish to stop receiving push notifications from us, you can change your settings in the Preferences section of your account. 

Promotions, Contests and Promotions

  • When you enter a contest or participate in a promotion, we may collect your name, address, email address, phone number, and any additional information or content required for the contest or promotion, including to deliver a prize to you, or that you otherwise provide, including your social media handle, profile picture and public posts or comments you make about our contest on social media networks. We use this information to administer the contest or

promotion. As part of a contest or promotion, we may also share or otherwise publish the content you submit to us. 

Social Media 

  • We may oer you the opportunity to engage with us on or through third-party social networking websites, plug-ins and applications, such as by logging in to your MyPanera® Canada account using your social media account credentials. Consequently, engaging with us on these platforms may allow us to have access to certain information associated with your social media account (e.g., name, username, email address, profile picture) to deliver the content or as part of the operation of the website, plug-in or application. When you provide information from your social media account, we may use this information to personalize your experience on our website and on the third-party social networking websites, plug-ins and applications. 

Want to Join our Team? 

  • In connection with a job application or related inquiry, you may provide us with certain personal information about yourself (such as that contained in a résumé, cover letter, or similar employment-related materials). We use this information for the purpose of processing and responding to your application for current and future career opportunities. 

Need to Contact Us? 

  • When you contact us, we may collect information that identifies you (such as your name, email address, phone number and country) along with any information you provide in your communications and additional information we need to help us promptly answer your question or respond to your comment. We retain this information to assist you in the future and to improve our customer service, products and services. 
  • We also may collect and use other information about you, your device, or your use of our services in ways that we describe to you at the point of collection or otherwise with your consent. 

Analytics 

  • We may use a third party such as Google Analytics to help us gather and analyze information about the areas visited on the website (such as the pages most read, time spent, search terms and other engagement data) in order to evaluate and improve the user experience and the website. How We Share the Information We Collect

The following provides information about purposes for which we may share your personal information. Our practices vary depending on the type of information and sharing. In addition to the sharing described in this Privacy Policy, we may share information about you with third parties whenever you consent to or direct such sharing. 

Service Providers 

  • Your personal information may be transferred (or otherwise made available) to aliates, subsidiaries and third parties that provide services on our behalf. We use service providers to provide services, such as hosting our website, processing payments, delivering our products and services, providing IT services such as detecting and preventing fraud and providing advertising and marketing services. Our service providers are only provided with the information they need to perform their designated functions and are not authorized to use or disclose personal information for their own marketing or other purposes. Our service providers may be located in Canada, the U.S. or another jurisdiction. 

Legal and Compliance 

  • When required by law or to protect our guests, employees, property, and/or legal interests, we, and the third parties we engage (including aliates), may use and share your personal information as we believe is necessary or appropriate to protect, enforce, or defend the legal rights, privacy, safety, or property of Better Bread, its aliates or business partners, our employees or agents or guests, to detect, suppress or prevent fraud or where otherwise required or permitted by applicable law or legal process. 

Franchisor 

  • Your personal information and other information may be transferred or otherwise made available to the franchisor of the Panera Bread® brand that

provides services to us and on our behalf in Canada, the U.S. or another jurisdiction. 

Sale of Business 

  • We reserve the right to transfer any information we have about you, including personal information, in the event that we seek to sell or transfer all or a portion of our business or assets to a third-party, such as in the event of a merger, acquisition, or in connection with a bankruptcy reorganization or other change in corporate control, or should any such transaction be proposed. 

Privacy and Access Choices Available To You. 

We work with third parties such as ad networks and other advertising companies that use their own tracking technologies (including cookies and pixel tags) on our website in order to provide you with tailored advertisements across the Internet. These companies may collect information about your activity on our website and third-party websites (such as web pages you visit and your interaction with our advertising and other communications) and use this information to make predictions about your preferences, develop personalized content and deliver ads that are more relevant to you on third party websites. This information may also be used to evaluate the eectiveness of our online advertising campaigns. 

Opt-Out of Interest-Based Advertising 

  • Our website displays a banner outlining our use of certain technologies to deliver relevant advertising to you on third-party websites and apps. You can choose to accept or reject the use of these technologies. If you choose to reject the use of such technologies, you may still see ads from Panera Bread® but they will not be tailored based on your visit to our website. To successfully opt out, you must have cookies enabled in your web browser (see your browser’s instructions for information on cookies and how to enable them). Your opt-out only applies to the specific web browser on the device you use to opt-out. So, if you use more than one browser or device, you must opt-out of each web browser on each device you use. Once you opt out, if you delete your browser’s saved cookies, you will need to opt-out again. 

Opt-Out of Marketing Communications 

  • If you have agreed to receive marketing communications from us, you can later opt-out by following the opt-out instructions in the marketing communications we send you. You may also have the ability to change your communication preferences (e.g. push notifications) using your device

settings. You can also opt-out by contacting us using the contact information provided below. 

  • If you do opt-out of receiving marketing communications from us, we may still send communications to you about your transactions, any accounts you have with us, and any promotions or contests you have entered. Opting-out of one form of communication does not mean you have opted-out of other forms as well. For example, if you opt-out of receiving marketing emails, you may still receive marketing text messages if you have opted-in to receiving them. 
  • We do not share personal information with third parties for their own direct marketing purposes, unless you give us permission to do so. When we give you notice, and you consent, we will share your personal information as you direct us to. 

Other Important Information 

Security 

  • To protect your personal information in our care or control, we take precautions including physical, organizational and technological measures to help protect personal information from being lost, misused, or inappropriately accessed or disclosed. 
  • Personal information may be accessed by persons within our organization, or our third-party service providers, who require such access to carry out the purposes described in this Privacy Policy, or otherwise permitted or required by applicable law. 
  • Even though we have taken steps to help protect the personal information in our care or control, you should know that we cannot fully eliminate security risks associated with personal information. No security measures can provide absolute protection. We cannot ensure or warrant the security of any information you provide to us. 

International Transfers of Personal Information 

  • Personal information that we collect may be stored and processed in Canada and outside your jurisdiction of residence, in any other country in which we or our service providers maintain facilities, including in the United States, and other countries. Personal information processed and stored in another country may be subject to disclosure or access requests by the governments, courts or law enforcement or regulatory agencies in that country according to its laws. 

Access to Your Personal Information, Corrections

  • Subject to applicable law, you have the right to access, update and correct inaccuracies in your personal information in our custody or control. You may request access, updating and corrections of inaccuracies in your personal information in our custody or control by emailing or writing to us at the contact information set out below. We may request certain personal information for the purpose of verifying the identity of the individual seeking access to his or her personal information records. 

Children’s Privacy Rights 

  • The Oce of the Privacy Commissioner of Canada considers children under the age of 13 to be unable to meaningfully consent. We do not knowingly collect any personal information from children under the age of 13 without parental consent. If we learn that a child for whom parental consent is required has provided us with personal information, we will use reasonable eorts to delete it in accordance with applicable law. If you are a parent or guardian of a child under the legal age of consent, and you believe your child has provided us with personal information, please contact us by following instructions at the “Contact Us” section below. 

Changes to Our Privacy Policy 

  • We may modify this Privacy Policy from time to time. We will notify you of changes by posting changes here, or by other appropriate means. Any changes to the Privacy Policy will become eective when the updated policy is posted on our App or the website. Your use of our services or your provision of personal information to use our services following such changes indicates your acceptance of the revised Privacy Policy.
